The cost of DWI defense varies from case to case. While there are certainly cheaper and more expensive attorneys, our experience, training and the hundreds of DWI/DUI cases we handle a year allow us to charge a little differently.  We pride ourselves on charging reasonable fees for the services you want. If you just want us to handle your driver’s license part only, we can do that. If you don’t want a trial, we will not factor a trial into our fee just to make a buck. Q: Is there a difference between DWI and DUI in Louisiana?

Different states call it different things, but they are all the same in Louisiana.  DWI (driving while intoxicated) is the same as DUI (driving under the influence) and OUI (operating under the influence). In fact, in Louisiana all are based on under the influence and not intoxication theory, meaning it is no longer good to tell a police officer “I only had 2 beers”, or “a sleeping pill last night”.  Both could be an admission used against you in court.  Remember that you still have a 5th amendment right to remain silent and not incriminate yourself.

Q: If I have a conviction for DWI, DUI or OUI in another state can it be used against me in Louisiana?

The quick answer is yes. However, if this is your case you definitely need a DWI/DUI attorney like Joe Larre` because the State (DA) must prove that the other state conviction is first valid under Louisiana law in form, procedure, and legal theory in order to be used against your arrest record.

Q: If I have a Commercial Driver’s License (CDL) are the laws and/or penalties different ?

Yes. First, if you have a federal endorsement, such as you can carry toxic waste, the time to appeal your driver`s license suspension goes from 30 days from your arrest to 5.   Second, the suspension of your CDL endorsement is longer than your regular class E license regardless of if you were driving your personal vehicle at the time of your arrest. Q: Can I get a DWI/DUI arrest off my record?

Q: Can I get a public defender to handle my driver’s license hearing and/or issues?

No you will not get a public defender.  In Louisiana your driver`s license is a privilege and not a constitutional right entitling you to an attorney if you cannot afford one.  However, the Joe Larre` Law Firm can represent you just for you license hearing.

Q: Am I required to give a breath or Blood sample?

No, not unless they present you with a warrant signed by a judge to take your blood only.  However, failure to give a sample could result in longer suspension of your driver`s license.  Refusing could keep you from mandatory jail time on the criminal side.

No, you do not have to perform any test; you have every constitutional right not to incriminate yourself.
